While Title VII outlaws discrimination in employment, how far does it go to outlaw retaliation against those who raise employment discrimination claims? The U.S. Supreme Court in its recent decision in the Burlington Northern v. White case significantly expanded the reach of the anti-retaliation statute beyond the work place. Will social snubs now become the basis for a federal case? Will every act of discipline in the work place result in yet another lawsuit? Do people who raise discrimination claims become "radioactive" and immune from discipline? How can employers manage their workforce efficiently while also managing their risk under the federal anti-discrimination laws?

This presentation with question and answer session will review the law before Burlington Northern, the U.S. Supreme Court opinion in that case, and how the law has changed as a result. Recent cases following that decision will also be discussed. Finally, the presentation will cover strategies for employers to follow that should help manage the potential risk presented by these sorts of claims.
