This presentation will review how an employer must balance its legitimate interest in preventing a hostile work environment while respecting the legitimate individual civil rights of its employees. The modern workplace must accommodate a wide diversity of people, all with differing religious, racial, cultural, sexual and political identities and backgrounds, while ensuring that the expression of such diversity does not intimidate or unduly offend the various members of the employee population. Topics to be covered in this presentation will include:
- Is it "art" or "sexual harassment," and what's the difference between "offensive" and "obscene"?
- Restrictions on the expression of religious, political or other views in the workplace, as well as on the display of religious or political symbols.
- Dress Codes v. Freedom of Expression, and the employee's right to appearance and expression on and off the job.
- When can an employer properly monitor and, if necessary, search an employee's workspace? A discussion of employee privacy rights in the use of company resources, such as e-mail, telephones, and computers and the employer's rights to control them.
- Where does "reasonable accommodation" end and "undue burden" begin?
