DETAILS:

This presentation will outline the legal frameworks of the Americans with Disabilities Act of 1990 and the Family and Medical Leave Act of 1993, with particular focus on the intersection of the two statutes which can cause numerous problems for employers. Employers must take care to avoid even the appearance of discrimination on the basis of disability, or retaliation against an employee taking FMLA leave. Topics to be covered in this presentation will include:

  • What does the ADA protect? What are an employer's obligations under the Act?
  • Thanks for the job offer. Oh, and I'm pregnant (or disabled). Now what?
  • Does an employer have to provide the "reasonable accommodation" the employee wants?
  • Where does "reasonable accommodation" end and "undue burden" begin?
  • Who qualifies for FMLA leave? What is protected? What isn"t?
  • When does leave constitute a reasonable accommodation under the ADA?
  • Is a "serious health condition" under the FMLA necessarily an impairment or a disability under the ADA? Can it be all of the above?
  • Can an employer fire an employee who is out on FMLA leave?
  • If an employee has used all 12 weeks of FMLA leave but still isn't ready to return to work, can the employer fire the employee?
